Terms of Service

1. Agreement

By creating an account or using the AgentGuard dashboard and API ("Service"), you agree to these terms. The Service is operated by BMD PAT LLC ("we", "us").

2. Service description

AgentGuard provides real-time observability, runtime guards, and a remote kill switch for AI agent systems. The Service includes the dashboard, ingest API, read API, and the open-source SDK.

3. Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials and API keys.
• One person or organization may not maintain more than one free account.
• We may suspend accounts that violate these terms or engage in abusive behavior.

4. Your data

You retain ownership of all trace data you send to AgentGuard. We do not claim intellectual property rights over your data. We will not access your data except to provide the Service, respond to support requests, or comply with legal obligations.

5. Acceptable use

You agree not to:

• Circumvent rate limits, quotas, or other usage restrictions
• Use the Service to store sensitive PII, credentials, or regulated data (PHI, financial records) in trace payloads
• Reverse engineer, scrape, or attempt to extract the source code of the dashboard
• Resell access to the Service without written permission

6. Billing & plans

• Free accounts have usage limits. Paid plans are billed monthly via Stripe.
• You can upgrade or downgrade at any time. Changes take effect immediately.
• Refunds are handled on a case-by-case basis. Contact support within 14 days of a charge.

7. Kill switch disclaimer

The remote kill switch is a best-effort feature. It depends on the SDK polling for signals and the agent honoring the kill instruction. We do not guarantee that a kill signal will stop any specific agent process. You are responsible for implementing appropriate safety mechanisms in your agent code.

8. Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. We are not liable for damages resulting from downtime or data loss.

9. Termination

You may delete your account at any time. We may terminate accounts that violate these terms with 30 days notice (or immediately for abuse). Upon termination, your data will be deleted per our retention policy.

10. Changes to terms

We may update these terms as the Service evolves. Material changes will be communicated via email at least 30 days in advance. Continued use after changes constitutes acceptance.
